Where a person is owed by money by another, there are several options for recovery.
If the debt is "liquidated" ie not needing assessment as to the value such as a repair bill, and less than $7,500.00 the Minor Debt Court can determine the dispute. Legal representation is not usually allowed in a hearing (although MDRN can assist in preparing, filing, serving and advising on the proceedings) and legal costs and interest will not be awarded even to a successful party. The cost of filing and serving the Claim is allowed.
Even if a Claim is less than $7,500.00 proceedings can be issued in the Magistrates Court where the local Magistrate resides over the Court action.
